These Terms of Use ("Terms") govern your access to and use of the Kolora application, related beta versions, and the Kolora Creative website (collectively, the "Services"). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Who provides Kolora
The Services are provided by Kolora Creative LLC ("Kolora," "we," "us," or "our"), a United States company. Contact information appears at the end of these Terms.
2. App license
Kolora is licensed, not sold. Subject to these Terms and any applicable Apple usage rules, Kolora grants you a limited, personal, non-exclusive, non-transferable, and revocable license to install and use the application on Apple-branded devices that you own or control.
Unless Kolora provides a separate custom end-user license agreement, an App Store version of Kolora is also subject to Apple's Standard Licensed Application End User License Agreement. If these Terms conflict with mandatory Apple terms for an App Store transaction, the applicable Apple terms control to the extent of that conflict.
3. The Kolora workflow
Kolora is a specialized color-grading tool designed to work with supported timeline packages. Kolora is not a replacement for maintaining your original editing project, source media, and backups. Compatibility may vary based on the Kolora version, LumaFusion version, package structure, media format, device, available storage, and operating-system version.
You are responsible for reviewing exported packages and grades before relying on them, delivering them to a client, deleting source material, or making other irreversible changes.
4. Your projects and media
You retain your rights in the video, audio, images, project files, grades, LUTs, and other materials that you import, create, or export using Kolora ("User Content"). These Terms do not transfer ownership of your User Content to Kolora Creative LLC.
You represent that you have all permissions necessary to use, modify, and export User Content through Kolora. You are responsible for your User Content, your backup practices, and the destinations to which you export or share files.
5. Local storage and backups
Kolora may create local working copies, extracted media, editable grade state, thumbnails, playback proxies, caches, generated LUT data, and export packages. Storage availability, device failure, operating-system behavior, app removal, or user action can result in loss of local data. Maintain independent copies of important projects and media.

6. Beta and TestFlight versions
Pre-release versions may be incomplete, contain errors, change without notice, and stop functioning. Beta features may differ from the final product or never be released. Do not use a beta as the only copy of an important project or in a workflow where a failure could cause material loss.
Your use of TestFlight is also subject to Apple's applicable terms. Feedback you voluntarily provide may be used by Kolora Creative LLC to evaluate, debug, improve, and develop Kolora without an obligation to compensate you. This does not transfer ownership of project media included in a support sample.
7. Purchases and subscriptions
If Kolora offers a paid download, in-app purchase, or subscription, the price, duration, features, and applicable trial terms will be displayed before purchase. Transactions made through Apple are billed and managed by Apple under the terms associated with your Apple Account and storefront.
An automatically renewing subscription continues for the disclosed period unless canceled through your Apple subscription settings before renewal. Deleting Kolora does not itself cancel a subscription. Refund requests for App Store transactions are handled under Apple's applicable policies and legal requirements. Features, plans, and prices may change prospectively as permitted by law; changes will not reduce a period already purchased except where necessary for security, legal compliance, or continued operation.
8. Acceptable use
You may not:
- use the Services in violation of law or another person's rights;
- attempt to bypass security, purchase validation, access restrictions, or technical limitations;
- reverse engineer, decompile, disassemble, or attempt to derive source code except to the limited extent such a restriction is prohibited by applicable law;
- distribute, sublicense, rent, lease, resell, or commercially provide access to the application except as expressly permitted;
- interfere with the operation, integrity, or security of the Services; or
- use the Services to process content when you do not have the right to do so.
9. Kolora intellectual property
Kolora, its software, interface, visual design, website, documentation, logos, trademarks, and other Kolora-provided materials are owned by Kolora Creative LLC or its licensors and are protected by applicable intellectual-property laws. No rights are granted except the limited rights expressly stated in these Terms.
10. Third-party products and services
Kolora may interoperate with or link to products and services provided by Apple and other third parties, including timeline editors, storage providers, and sharing destinations. Those products and services are governed by their own terms and privacy practices. References to third-party products do not imply ownership, sponsorship, or endorsement.
11. Updates, changes, and availability
We may update, modify, suspend, or discontinue all or part of the Services. Updates may be required for continued compatibility, security, or operation. We do not guarantee that Kolora will support every project, media format, third-party application version, device, or operating-system version.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPATIBLE WITH EVERY FILE OR WORKFLOW, OR FREE FROM LOSS OR CORRUPTION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THESE TERMS MAY NOT APPLY TO YOU.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOLORA CREATIVE LLC AND ITS MEMBERS, PERSONNEL, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, MEDIA, PROJECTS, REVENUE, PROFITS, BUSINESS, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOLORA CREATIVE LLC'S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR KOLORA DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR FIFTY U.S. DOLLARS (US $50). THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW.
14. Termination
You may stop using Kolora at any time. We may terminate or suspend your license if you materially violate these Terms, subject to applicable law. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and dispute provisions—will survive.
15. Governing law
Except where the law of your place of residence requires otherwise, these Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Nothing in these Terms limits consumer rights that cannot legally be waived.
16. Changes to these Terms
We may update these Terms to reflect changes to Kolora, our business, Apple platform requirements, or applicable law. We will post the updated Terms at https://koloracreative.com/terms and revise the "Last updated" date. Additional notice will be provided where required by law.
